Ben & Jerry’s Wins Court Order to Stop “Ben & Cherry’s”

“Ben & Cherry’s” sounds kind of familiar, doesn’t it? Well, it’s a brand name that has little to do with an ice cream brand that you might know. It’s actually a series of pornographic DVDs produced by a company called Caballero Video with titles like “Boston Cream Thigh” and “Peanut Butter D-Cup.”

Ice cream-maker Ben & Jerry’s filed a trademark infringement suit against Caballero Video (a/k/a Rodax Distributors Inc.) and won a temporary court order to halt the sale and advertising of the adult DVDs with names that are similar to its ice cream flavors. Ben & Jerry’s, a subsidiary of Unilever, is known for its cleverly named flavors, including Cherry Garcia, Karamel Sutra, Chubby Hubby, and Stephen Colbert’s AmeriCone Dream.

Caballero was also ordered to get rid of its DVD packaging design that included grassy fields and puffy clouds like Ben & Jerry’s, with the added feature of some scantily clad women. It’s been reported that the company has agreed to pull the DVD series off the market.

Probably the most PC question to ask here is: What’s your favorite ice cream flavor?
