Medical Marijuana Trademarks Up in Smoke

Here’s an interesting ruling from the USPTO. After an April 1st creation of a medicinal marijuana category for trademark filings, the PTO has removed the selection from its website. Since medical marijuana is legal only in certain states, therefore not always available for interstate commerce, the PTO could not accept the filings. A slew of names such as Maui Wowie, Pot-N-Candy and Tartukan Death Weed were filed during the brief lifespan of the new category, proving that we’ll be missing out on some of the more creative trademark names seen in quite some time.
